2019 Tennessee Elk Tag Raffle Rules
OFFICIAL RAFFLE RULES AND CONDITIONS
Drawings for the Raffle will be held on Monday, August 5, 2019 at 10:00AM, at TWRA’s headquarters in Nashville, TN. Tickets will not be sold after midnight, Friday, August 2, 2019. TWRA executive staff will be present to conduct and/or observe the drawing. This offer is void where prohibited by law, and all federal, state and local laws and regulations apply.
The IRS has taken the position that amounts paid for chances in raffles, lotteries or similar drawings for valuable prizes are not gifts, and consequently, do not qualify as deductible charitable contributions. Prize winners are responsible for the payment of all local, state and federal taxes resulting from the income attributable to the receipt of any prizes, and should consult their professional legal and accounting advisors regarding the tax effects of their respective choices.
Tickets are $20.00 each, 3 for $50, or 10 for $100. You may buy as many tickets as you wish. All sales transactions are final. No payments will be refunded.
Only one eligible person may be entered in the raffle for each entry (i.e., for each ticket) sold. In other words, only one name, one method of payment, and one e-mail address are permitted per entry. If the name of more than one person is submitted with a ticket purchase, and that ticket is selected as a winning ticket, then the person named first will be deemed the holder of record of that ticket and declared the winner. Division of any prize by a group purchasing a ticket in common shall be the sole responsibility of the person named as or deemed the holder of record of that ticket, should that ticket be selected as a winner.
Tickets can be purchased online at www.twrf.net, or through TWRA’s license sales portal. Ticket purchases can be made by Visa, MasterCard, Discover or American Express. Mail in orders are not accepted.
By entering this raffle, each entrant:
Accepts and agrees to be bound by all the rules, limitations and restrictions set forth herein.
Agrees that their names, resident city, and/or their likenesses may be disclosed to and used by the news media, in lists of prize winners (name and city only) to be published on the TWRF or TWRA website, and may otherwise be used by TWRF or TWRA for publicity purposes.
Releases TWRF, its trustees, officers, employees, and agents from any and all liability for injuries, losses or damages of any kind or caused by or resulting from acceptance, possession and use or misuse of any prize. Each winner also agrees to indemnify and hold TWRF harmless from any and all losses, damages, rights, claims and actions of any kind arising in connection with or as a result of the winner’s choice of winner options and acceptance or use of any prize.
TWRF reserves the right to cancel, suspend and/or modify the raffle, or any part of it, if any fraud, technical failures or any other factor beyond TWRF’s reasonable control which impairs the integrity or proper functioning of the raffle, as determined by TWRF in its sole discretion. TWRF reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the raffle process or to be acting in violation of these official rules or any other promotion or in an unsportsmanlike or disruptive manner.
If for any reason the raffle is cancelled, TWRF must reimburse each raffle ticket purchase within 60 days of the raffle cancellation date.
The deadline for purchasing tickets for the raffle drawing is 11:59 PM on Friday, August 2, 2019. All tickets purchased by that time will be entered into the drawings on Monday, August 5, 2019.
Every ticket sold will be assigned a unique identification number (as well as the purchaser's name and e-mail address). The identification number for each ticket sold will be entered into an excel spreadsheet. Within excel, a random number function will be applied to select a random number between 1 and the total number of tickets sold.
The winning tickets will be electronically drawn as follows:
Grand Prize – The first eligible number drawn will be awarded the conservation elk tag and Best of the West Shooting System.
2nd Place – The second eligible number drawn from the remaining tickets will be awarded the Polaris Ranger 570 in Pursuit camo.
3rd Place – The third eligible number drawn from the remaining tickets will be awarded a $2,500.00 Bass Pro Shops/Cabela’s gift card.
4th Place – The fourth eligible number drawn will be awarded .50 cal Knight Mountaineer muzzleloader.
5th Place – The fifth eligible number drawn will be awarded the hunting gear package.
GRAND PRIZE WINNER OPTIONS
The elk tag is for the 2019 season only. The 2019 Tennessee Gun Elk Season is October 12th through the 18th. If the winner cannot, or chooses not participate in the hunt, he or she can choose to transfer the elk tag to an eligible hunter, one time. If the awardee wishes to transfer the tag, they must contact TWRA no later than Friday, August 30, 2019 to obtain authorization. No monetary gain can be made on the transaction. Once the tag has been transferred, it cannot be transferred again.
In the event a winner cannot be contacted, fails to respond within 7 calendar days, fails to otherwise qualify for the prize and /or declines the prize, an alternate winner will be selected. Prizes must be claimed within 90 days of drawing. Any unclaimed prize after that date will constitute forfeiture and will remain the property of the TWRF.
LIMITATION OF TWRF RESPONSIBILITIES
It is the responsibility of the winners to determine, to his or her satisfaction, the value of the respective prizes, and the tax effect and liabilities associated with each of them, in light of their personal financial circumstances. TWRF provides no guarantee or warranty as to the condition or value of the prizes.
Tennessee state law requires that you must be at least 18 years old to enter. The winner of the rifle must be eligible to legally own a firearm according to federal law. TWRF’s employees, officers, directors, and their immediate families are excluded from participating. Providers of prizes (and their immediate families) and certain event vendors, and their immediate families, employees, agents, and subcontractors are also prohibited from purchasing tickets or winning any prize.
Any dispute arising with respect to this raffle shall be resolved by binding arbitration conducted in Nashville, TN, in accordance with the Rules of the American Arbitration Association. The decision of such arbitration shall be final and no appeal may be taken therefrom.
REGISTRATION WITH THE STATE OF TENNESSEE
The Tennessee Wildlife Resources Foundation, Inc. (TWRF) was established as a 501(c)(3) nonprofit organization in 1999 to support the Tennessee Wildlife Resources Agency (TWRA) and to promote habitat conservation, responsible land stewardship, and the preservation of Tennessee's hunting and fishing heritage. The TWRF made application to the Tennessee Secretary of State’s office, and was subsequently authorized by the Tennessee General Assembly to conduct this raffle.
